As marriage rates declines and divorce rates increase, many parties are making the modern decision to have children outside of marriage.
Under Ohio Revised Code Section 3109.042, any unmarried woman who gives birth is the custodian of the child until a court determines otherwise. That does not mean that a father, after establishing paternity, cannot be awarded custody.
